Terms & Conditions for Alux Collective, Hospitality and Travel LLC
Introduction
These Terms & Conditions govern your use of our website and services. By using our website and services, you agree to comply with and be bound by these terms. If you do not agree with these terms, please do not use our website or services. This agreement is established between Alux Collective, LLC (the “Booking Agent”) and you (the “Client”).
1. Services
Alux Collective acts as a third-party booking agent between the Client and multiple vendors. Each vendor’s policies and cancellation fees are different and are binding only between each vendor and the Client. Alux Collective is responsible for coordination between the Client and vendors prior to the experience but is not liable for the experience itself.
2. Deposit
2.1. A 50% deposit is due at the time of agreement to the proposal. Inability to fulfill the deposit within 5 days prior to arrival will result in the cancellation of all bookings.
2.2. The Service Fee and Restaurant Reservation Fee cover the creation of a personalized itinerary, including making and modifying any experiences and restaurant reservations prior to your arrival. The agreed-upon Alux Collective Service Fee and Restaurant Reservation Fee are non-refundable, regardless of any modification to the itinerary. These fees also cover any modifications to experiences and reservations as stipulated in clause 3.1.
3. Payment
3.1. The final invoice must be paid in full upon receipt. Failure to pay within 7 days will result in an accruing penalty of 5% of the total due for each day of missed payment.
3.2. Payments made to Alux Collective through a third-party service, such as PayPal and QuickBooks, are subject to a 5% Service Fee.
4. Cancellation & Rescheduling
4.1. Any changes to the schedule must be made 48 hours in advance of the event to ensure availability. Experiences modified or canceled within 24 hours of the event may result in the full price of the service. Restaurant reservation modifications or changes can be made up to 6 hours ahead of the reservation.
4.2. To ensure a refund for any experience canceled or rescheduled, the Client must contact Alux Collective within 72 hours prior to the event.
5. Transportation
5.1. All transportation services booked through Alux Collective have determined pick-up and drop-off locations agreed upon in advance. During transportation, clients and the transportation service are not permitted to make any unscheduled stops. Any deviations from the transportation route that may incur traffic violations, towing of the vehicle, or other inconveniences are the responsibility of the Client and the transportation service. Any claims can only be disputed between the Client and the transportation service.
6. Disclaimer
6.1. Alux Collective shall not be held liable to the Client for failure to provide the services ordered if such failure is due to actions and circumstances beyond the control of Alux Collective.
6.2. The Client understands that if they encounter any problems with any experience provided by Alux Collective, they have a responsibility to contact Alux Collective as soon as possible during the event while the event is still occurring and allow Alux Collective ample time and opportunity to correct or improve the situation. If the Client does not contact Alux Collective or the experience vendors through the completion of the experience or stops communicating with Alux Collective during an event after initially raising a concern, they are implicitly indicating their satisfaction with the experience and are not entitled to a refund.
6.3. If the Client decides to make a change in the experience or service once it has already begun, the Client is responsible for coordinating directly with the experience vendor and must immediately notify Alux Collective and allow ample time and opportunity to correct or improve the situation. Any claims regarding issues that may occur throughout the experience or service are to be disputed between the service vendor and the Client.
7. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Alux Collective operates.
8. Changes to Terms & Conditions
Alux Collective reserves the right to modify these Terms & Conditions at any time. Any changes will be posted on our website, and your continued use of our services after such changes have been posted constitutes your acceptance of the new Terms & Conditions.
